In the aftermath of the Jacobite Rising of 1745, Scottish piper James Reid was captured while serving with Lord Ogilvy's regiment and brought to trial for high treason in York. Reid's defense argued that he had carried no weapon and had served only as a piper. The court disagreed, reasoning that a Highland regiment did not march without its piper and declaring his bagpipes, in the eyes of the law, an "instrument of war." Reid was convicted and executed in 1746.

Although bagpipes were never specifically listed in the 1746 Act of Proscription, Reid's trial helped create the enduring legend of the forbidden Highland pipes. It's a story of music, rebellion, and Scottish defiance that has echoed through the years to this day.
